On April 9, 2022, a 911 caller reported {that a} man was waving a handgun within the parking zone of a liquor retailer within the 100 block of East Arrow Highway, the DOJ mentioned in a launch on Wednesday. Daniel Valdivia was ordered by arriving officers to place his palms within the air and to get down onto the bottom.
Valdivia assumed {a partially} susceptible place on the bottom. He then reached for his waistband and pulled out what seemed to be a handgun and pointed it at officers, in accordance with the report.
Three officers fired a mixed 12 pictures at Valdivia, who was taken to a hospital and pronounced dead. The weapon was decided to be a BB gun by investigators.
The Department of Justice, which is required to research officer-involved shootings ensuing within the demise of an unarmed civilian below AB 1506, discovered the officers acted with intent to defend themselves and others and decided that legal fees won’t be pursued towards the officers.
