Jetstar Japan loses lawsuit over disciplinary motion in opposition to cabin crew


The Tokyo District Court has dominated as invalid Jetstar Japan’s suspension of two cabin crew members in relation to a pay dispute that befell two years in the past.

Presiding Judge Hideaki Gunji on Monday stated the suspensions had been unjustified and dominated in favor of the plaintiffs of their lawsuit in opposition to the Narita-based low-cost provider. The judge ordered the airline to pay again wages to the plaintiffs for the suspension durations.

The first plaintiff, a union chief, had despatched an e mail to union members in March 2022, alleging that Jetstar had been withholding worker allowance funds. The airline contended that the e-mail was despatched in a private capability and designed to incite dissatisfaction amongst staff, and suspended the person for 20 days.

The second plaintiff was suspended for 15 days for accusing a superior, who addressed claims of stated unpaid allowances, of insincerity, which Jetstar argued brought on emotional misery to the latter.

The judge dominated that the union chief’s e mail was doubtless despatched utilizing union sources and dismissed Jetstar’s assertion that it was a private act.

As for the second plaintiff, whereas the judge acknowledged the accusation of insincerity might trigger emotional misery, he deemed the disciplinary measure meted out as “grossly disproportionate” on condition that the claims turned out to be true.

Jetstar stated it had not reviewed the ruling and declined to remark.
